Welcome to Supertall. By using our iOS mobile application (the "App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.
1. Acceptance of terms
By downloading, accessing, or using the Supertall app, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are under 18, you represent that you have obtained parental or guardian consent.
2. Description of service
Supertall is a health and fitness mobile application that provides:
- Personalized exercise and stretching programs
- Height and posture tracking tools
- Daily challenges and gamification features
- Premium subscription features ("Supertall Premium")
We reserve the right to modify, suspend, or discontinue any part of the Service at any time.
3. User accounts
- You may create an account using your email or Apple ID.
- You are responsible for keeping your login credentials secure.
- You must be at least 13 years old to create an account.
- You are responsible for all activity under your account.
4. Subscription & payments
Free trial: Supertall Premium starts with a 3-day free trial. You will not be charged if you cancel before the trial ends.
Premium subscription:
- Monthly: $9.99/month
- Annual: $79.99/year
- Subscriptions are billed through the App Store (Apple).
- All sales are final; no refunds for used periods.
- Subscriptions auto-renew unless cancelled at least 24 hours before the end of the billing period.
- You can manage or cancel subscriptions in your App Store account settings.
5. Health & fitness disclaimer
Important: Supertall is not a medical device and is not intended to:
- Diagnose, treat, cure, or prevent any disease or medical condition
- Replace professional medical advice
- Provide guaranteed height increase results
You should consult a healthcare professional before starting any exercise program, especially if you:
- Have any pre-existing injuries or medical conditions
- Are under 18 and your growth plates may not be closed
- Are taking medication that affects bone or muscle health
The information provided through Supertall is for general informational purposes only. Individual results vary based on age, genetics, nutrition, and other factors.
6. Acceptable use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access
- Reverse engineer, decompile, or disassemble the App
- Upload viruses, malware, or harmful code
- Interfere with the App's operation
- Create multiple accounts to abuse the referral system
- Post false reviews or testimonials
7. Intellectual property
- The App, including all content, design, code, and trademarks, is owned by Supertall Inc.
- You retain ownership of content you submit (photos, measurements).
- By posting content, you grant Supertall a non-exclusive, royalty-free license to use it for the Service.
- You must not upload content that infringes on others' intellectual property rights.
8. User-generated content
- You are solely responsible for content you submit.
- Supertall does not endorse user-submitted testimonials or reviews.
- We may remove content that violates these Terms.
9. Third-party services
The App may include links or integrations with third-party services (e.g., Apple HealthKit, App Store). These services are governed by their own terms and privacy policies.
10. Limitation of liability
To the maximum extent permitted by law:
- Supertall is provided "as is" and "as available".
- We make no warranties about the accuracy, completeness, or reliability of the App.
- We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App.
- Our total liability shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Supertall, its officers, employees, and agents from any claims, damages, or expenses arising from your violation of these Terms or your misuse of the App.
12. Modifications to terms
We may update these Terms at any time. If we make material changes, we will post the updated Terms in the App and update the "Effective Date" at the top. Your continued use after the changes take effect constitutes your acceptance of the new Terms.
13. Termination
We may suspend or terminate your account if you violate these Terms or engage in fraudulent activity. You may delete your account at any time through the App settings.
14. Governing law
These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.
15. Dispute resolution
Any dispute arising from these Terms or your use of the App shall be resolved in the courts of San Francisco County, California. You agree to personal jurisdiction in those courts.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.
